1. Acceptance of Terms

By downloading, installing, or using Maushwave ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

Maushwave is a neuroacoustic wellness application that provides:

• Audio journeys combining binaural beats, ambient soundscapes, and spoken affirmations
• Personal affirmation recording and playback
• Subliminal audio layers (affirmations played at reduced volume beneath conscious audio)
• Gamified progress tracking (streaks, points, levels)
• Circadian-adaptive session selection

3. Important Health Disclaimer

• The App is designed for general wellness and personal development purposes only.
• It is not a substitute for professional medical advice, diagnosis, or treatment.
• If you have a medical condition, mental health disorder, or are taking medication, consult your healthcare provider before use.
• Binaural beats may not be suitable for people with epilepsy or seizure disorders.
• Do not use the App while driving, operating machinery, or in any situation requiring full attention.
• We make no claims about the therapeutic efficacy of subliminal audio. Subliminal affirmations are provided as a personal development tool.

4. Subliminal Audio Disclosure

Maushwave uses multi-layer audio technology. During journeys, you may hear:

1. Conscious layer: Clearly audible spoken affirmations
2. Subliminal layer: The same affirmations played at reduced volume beneath ambient audio
3. Background layer: Ambient soundscapes (e.g., ocean waves) and optional binaural beats

The affirmation content used in subliminal layers is always the same content available in the conscious layer — there is no hidden or different content. You can view all affirmation texts in the App's content library at any time.

You can enable "Reveal Mode" in the App to bring subliminal layers to audible volume for verification.

5. Eligibility

You must be at least 13 years of age to use Maushwave. By using the App, you represent that you meet this requirement.

6. Account-Free Design

Maushwave does not require account creation. There is no username, password, or profile. Your identity is represented solely by an anonymous device identifier hash that cannot be reversed to identify you personally.

7. Subscriptions & Payments

7.1 Free Tier

Maushwave offers a free tier with limited content (50 affirmations, 3-minute preview journeys). The free tier is available indefinitely with no payment required.

7.3 Payment Processing

All payments are processed by Stripe, Inc. When you subscribe, you are redirected to a Stripe-hosted checkout page. We never see or store your payment card details. Stripe's terms of service and privacy policy apply to all transactions.

7.4 Auto-Renewal

Monthly and Annual subscriptions automatically renew at the end of each billing period. You will be charged the then-current price unless you cancel before the renewal date.

7.5 Cancellation

You may cancel your subscription at any time through the Stripe Customer Portal (accessible via the App: Settings → Manage Subscription). Upon cancellation:

• Your subscription remains active until the end of the current billing period.
• You will not be charged again.
• After the billing period ends, your access reverts to the free tier.
• Your local data (recordings, history, settings) is not deleted.

7.6 Refunds

Refund requests are handled on a case-by-case basis. Contact support@maushwave.com within 14 days of purchase. Lifetime purchases are non-refundable after 14 days except where required by applicable law.

7.7 Free Trials

Some subscription plans include a free trial period. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the listed price.

7.8 Subscription Recovery

If you change devices, you can recover your subscription using the Stripe Customer ID displayed in the App (Settings → Subscription). Enter this ID on your new device to restore access. If you lose your recovery information, contact support@maushwave.com with proof of purchase (Stripe receipt email).

8. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or disassemble the App
• Redistribute, resell, or sublicense the App or its content
• Use the App for any unlawful purpose
• Attempt to circumvent subscription restrictions or tamper with entitlement verification
• Extract or redistribute the audio content, affirmation texts, or other intellectual property
• Use automated tools to access the App's backend services beyond normal use

9. Intellectual Property

All content in the App — including audio recordings, affirmation texts, user interface design, and branding — is owned by Maushwave or its licensors and is protected by copyright and intellectual property laws.

Your personal recordings created within the App belong to you. We do not claim ownership of content you create.

10. Distribution

Maushwave is distributed as a direct APK download, not through the Google Play Store or Apple App Store. By installing the App, you acknowledge that:

• You may need to enable "Install from unknown sources" in your Android settings
• Updates are delivered via in-app update checks, not via an app store
• Google Play Protect may display a warning for apps not distributed via the Play Store — this is normal and expected

11. Availability & Updates

We strive to keep the App and backend services available, but we do not guarantee uninterrupted access. We may:

• Release updates that change features or functionality
• Temporarily suspend services for maintenance
• Discontinue the service with reasonable notice (minimum 30 days for paid subscribers)

The App is designed to function primarily offline. Core features (journey playback, recordings, progress tracking) work without an internet connection.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
• We disclaim all warranties, including but not limited to fitness for a particular purpose, merchantability, and non-infringement.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability for any claims arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Maushwave, its operators, and affiliates from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ireland.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the App after changes constitutes acceptance of the new Terms. For material changes, we will provide notice through the App or via the website.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
